These Terms of Service ("Terms") govern your access to and use of the actify.fit mobile application and website (collectively, the "Service"), operated by Actify Fitness LLP ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the confidentiality of your account and for all activities under your account.
  • You agree to notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. The Service

actify.fit provides:

  • AI-generated personalized workout and nutrition plans
  • Health and fitness tracking (workouts, nutrition, water, body metrics)
  • Gamified scoring, streaks, XP, and achievements
  • Integration with Apple Health
  • Progress analytics and insights

4. Health Disclaimer

The Service is for informational and motivational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

  • AI-generated workout and diet plans are based on the information you provide and general fitness guidelines. They are not reviewed by a medical professional.
  • Always consult your physician or qualified health provider before starting any new exercise or nutrition program, especially if you have pre-existing health conditions.
  • Stop exercising immediately and seek medical attention if you experience pain, dizziness, or discomfort.
  • We are not liable for any injury, health issue, or adverse effect resulting from following plans or recommendations provided by the Service.

5. Subscriptions & Payments

5.1 Free Tier

The Service offers a free tier with core features. No payment is required for the free tier.

5.2 Premium Subscription

  • Premium features are available through a paid subscription (monthly or annual).
  • Subscriptions are billed through the Apple App Store or Google Play Store. Payment terms are governed by the respective platform.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription through your device's app store settings.

5.3 Refunds

Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies. We do not process refunds directly.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Impersonate another person or entity
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated scripts, bots, or scraping tools to access the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Submit false, misleading, or fraudulent information

7. Intellectual Property

  • The Service, including its design, code, content, logos, and AI models, is owned by Actify Fitness LLP and protected by intellectual property laws.
  • You retain ownership of the personal data you submit (e.g., workout logs, meal entries).
  • You grant us a limited license to use your data solely to provide and improve the Service.
  • You may not copy, modify, distribute, or create derivative works of the Service without our written consent.

8. Third-Party Services

The Service integrates with third-party platforms (e.g., Apple Health). Your use of these integrations is subject to those platforms' terms and privacy policies. We are not responsible for third-party services.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.
  • We do not warrant that the Service will be uninterrupted, error-free, or secure.
  • In no event shall Actify Fitness LLP, its officers, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Actify Fitness LLP and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Account Termination

  • You may delete your account at any time. See our Data Deletion page.
  • We may suspend or terminate your account if you violate these Terms, with or without notice.
  • Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (e.g., liability, indemnification) will remain in effect.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and revising the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force.
